Proposed Revocation of Trenching Bylaw 2002
Pursuant to Section 83 of the Local Government Act 2002, the Southland District Council gives notice that the special consultative procedure in respect of the proposed revocation of this Bylaw has commenced. It is proposed that the Bylaw be revoked as it has been superseded by the Utilities Access Act 2010 and National Code of Practice for Utility Operators' Access to Transport Corridors.
A copy of the Statement of Proposal together with the 2002 Bylaw and that part of the Code relating to trenching is available from any Council office.
Submissions in respect of the proposed revocation are invited, closing by the end of business on Tuesday, 18 June 2013. Submissions should be lodged in writing and addressed to:

Temporary Road Closure - Old Snow Pole Track
That council, pursuant to section 342(1)(b) of the Local Government Act 1974 and clause 13 of the tenth schedule thereto, hereby resolves to temporarily close and prohibit traffic using that section of road commencing at the point where Old Snow Pole Track joins Canton Road and continuing along that section of Old Snow Pole Track to the boundary of the Southland District Council with the Central Otago District Council for the period 4 June 2013 to 25 October 2013 owing to climatic conditions because the use of that section of road may cause damage to the road.
That prohibition shall apply to all motor vehicular traffic such that it will be an offence for any unauthorised vehicle to use the above described section of road during the period of prohibition. Authorised vehicles shall be those belonging to adjacent run holders and those to whom written authorisation has been given after special application to the council.

Proposed Southland District Plan 2012 - Summary of Submissions
The Southland District Council gives notice that it has prepared a summary of decisions requested by submitters to the Proposed Southland District Plan 2012, in accordance with Clause 7 of the First Schedule of the Resource Management Act 1991. The Summary of Submissions document summarises the decisions and changes requested, or inferred, from each of the submissions received on the proposed Southland District Plan. The further submissions process provides an opportunity for appropriate persons to make further comment on those matters raised in the previous submissions process. How can I make a further submission?
Under Clause 8(1) of Schedule One of the Resource Management Act 1991, any person who has an interest greater than the general public or are representing a relevant aspect of the public interest, can make a further submission, even if you didn't make a submission previously. However, further submissions can only support or oppose, part or all of an original submission. New issues cannot be raised. Submission forms may be obtained from:

Viaduct Closure
As a result of continuing structural deterioration in timber members and steel cross bracing, the Percy Burn Viaduct on the South Coast Track is no longer safe for public use. Council hereby confirms that a formal Dangerous Building Notice has been issued in respect of the viaduct. An alternate bypass route around the viaduct has been constructed by the Department of Conservation.

Revocation of Total Fire Ban
The Southern Rural Fire Committee as Fire Authority for Southern Rural Fire District gives notice to the public the Total Fire Ban (Prohibited Fire Season) currently in force in the District has been revoked from 9.00 am, Saturday, 27 April 2013. This excludes the Naseby Zone where a Total Fire Ban is in place.
1. The public is reminded that a Restricted Fire Season will remain in place.
2. No fire shall be lit in the open air within Southern Rural Fire District during the Restricted Fire Season without a written permit from a Rural Fire Officer of the District, except for the following which do not require permits as long as the following conditions are met:
(a) Incinerators; conditions - incinerator is designed to prevent the escape of fire and ashes, is no closer than five metres to any building, tree, hedge, fence or other combustible material, a water supply sufficient to control any spread of fire is available, all embers and ashes are totally extinguished after burning and before dark.
(b) BBQ/Cooking Fires; conditions - fire is no closer five metres to any building, fence, hedge or other combustible material, a water supply sufficient to control any spread of fire must be available, all embers and ashes are totally extinguished after burning and the BBQ is not left unattended, (gas BBQs are preferred).
(c) Offal Hole (only applies in rural areas); conditions - there must be a cleared area of at least 30 metres from any other combustible material, a water supply sufficient to control any spread of fire must be available.
(d) Hedge/Tree Trimmings (only applies in rural areas); conditions - fire is no larger than two metres by two metres, fire is 30 metres away from and on the downwind side of any shelterbelt, trees, fences, buildings or other combustible material and the wind is blowing away from the above.
No fires are to be lit when conditions are such or are predicted, (eg strong winds) that the fire is likely to spread.
3. It is the responsibility of people lighting fires to make sure they are safe at all times and cannot spread. It is no legal defence that the fire was of a type or lit at a time permitted by this notice.
4. People seeking further information or wishing to obtain fire permits can contact the Southern Rural Fire Authority fire permit line during work hours on 0800 773 363. Please allow five working days to process permit applications and undertake inspections of the area concerned.

Pursuant to the Transport (Vehicular Traffic Road Closure) Regulations 1965, notice is given that Council will close Waikawa Valley Road from Buckingham Road to Mokoreta-Tahakopa Road to normal traffic between the hours of 10.00 am to 6.00 pm on Saturday, 27 April 2013. The purpose of the closure is to enable the Eastern Southland Car Club to hold a Gravel Hill Climb. A detour will not be available but the road will be reopened as soon as safely possible in the event of an emergency. It will be an offence for vehicles to use the road during the period of closure without the prior written approval of the Group Manager Services and Assets.

Draft Annual Plan 2013/2014
Residents, ratepayers and interested persons are invited to comment on the Southland District Council's Draft Annual Plan 2013/2014.
The Draft Annual Plan describes what Council is proposing to do in the community from 1 July 2013 to 30 June 2014. It includes the cost of delivering Council's proposed activities, how it intends to fund these (including the amount of rates required), how progress will be measured and explains any differences from what was proposed for that period in its Ten Year Plan 2012-2022.
A summary of what is proposed will be delivered to all District residents' and non-resident ratepayers' mailboxes in April. Further copies of the summary as well as a copy of the full draft document can be obtained free of charge from any Council office or inspected at any of the District's libraries. They can also be viewed online.
Details on how to make a submission are set out in the Draft Annual Plan and summary. Submissions should be received by Council by 4pm on Wednesday, 1 May 2013.
For those that wish to speak to their submission, a meeting to hear and consider submissions will be held on 27 and 28 May 2013.

Subdivision, Land Use and Development Bylaw 2012
Pursuant to the provisions of Section 157 of the Local Government Act 2002, notice is hereby given that the Southland District Council made the Subdivision, Land Use and Development Bylaw 2012 at its meeting on 6 March 2013. The Bylaw comes into force on 22 March 2013 and may be inspected at any office of the Southland District Council. Southland District Council Funding Deadlines
Grants are available for arts and cultural projects and must meet one or more of the following criteria:
Broad community involvement - The project will create opportunities for local communities to engage with and participate in arts activities.
Diversity - The project will support the diverse arts and cultural traditions of local communities, enriching and promoting their uniqueness and cultural diversity.
Young People - The project will enable and encourage young people (under 18 years) to engage with and actively participate in the arts.
** School based projects are generally not eligible but call us to discuss your ideas.**

SOUTHLAND DISTRICT COUNCIL - COMMUNITY INITIATIVES FUND
Grants are available for the development of:
• Community facilities or amenities including:
- Community Centres / Halls
- Local reserves and picnic areas
- Playgrounds
- Walkways and tracks
- Sports fields
- Swimming pools
- Changing room facilities associated with the above
• Sport and recreational opportunities
• Community programmes, activities or events
Assistance for other initiatives outside the above broad categories may be provided at the discretion of the Allocation Committee
SPORT NZ - RURAL TRAVEL FUND
The Rural Travel Fund is designed to assist with transport expenses associated with participating in regular local competitions. Sports clubs and school based clubs with young people aged between 5-19 years are eligible to apply.

OHAI RAILWAY FUND
Grants and loans are available for the benefit of residents of the former Ohai Railway Board area.

Proposal to Temporary Close Road - Palmerston Street (SH 99), Riverton
Pursuant to the Transport (Vehicular Traffic Road Closure) Regulations 1965, notice is given that Council proposes to close Palmerston Street, from Princess Street to Osborne Street to normal traffic between the hours of 10.00 am to 11.00 am on Thursday, 25 April 2013.
The purpose of the closure is to enable the Annual ANZAC Parade.
A detour will be available via Havelock Street and Jetty Street.

Review of Gambling and TAB Venue Policies

Proposed Southland District Plan 2012
The Southland District Council gives notice that it has undertaken a review of the Operative Southland District Plan 2001 and is publically notifying the Proposed Southland District Plan 2012.
The purpose of the Southland District Plan is to assist the Southland District Council to carry out its functions in order to achieve the purpose of the Resource Management Act 1991. Once the Southland District Plan 2012 becomes operative, it will replace the Southland District Plan 2001. Pursuant to Section 86B(1)(c) Rules relating to Biodiversity will not have legal effect until those provisions have been through the public submission, hearing and decision process and are deemed operative.
Copies of the Proposed Southland District Plan 2012, submission form and accompanying reports are available for public inspection at:
- Public libraries within the Southland District - Winton, Lumsden, Otautau, Nightcaps, Riverton/Aparima, Stewart Island/Rakiura, Te Anau, Waiau and Wyndham.

The process for public participation in the consideration of the Proposed Southland District Plan under the Act is as follows:
Any person may make a submission, in the prescribed form, on the Proposed Southland District Plan 2012. Any person may make a submission, but if the person could gain an advantage in trade competition through the submission, then the person may do so only if the person is directly affected by an effect of the proposal that -
• adversely affects the environment; and
• does not relate to trade competition or the effects of trade competition.

Following receipt of submissions to the Proposed Southland District Plan 2012, the process for further public participation is as follows:
Summaries of the submissions will be prepared by way of public notice, advice will be given of the places where the summaries of submissions and the submissions themselves may be inspected;
The following persons may make a further submission:
- any person representing a relevant aspect of the public interest;
- any person that has an interest in the proposal greater than the interest that the general public has; and
- the local authority itself.
Southland District Council will hold a public hearing, for the purpose of allowing those submitters who wish to be heard, to present further material in support of their submission or further submission:
- following the release of Southland District Council's decisions on the submissions, any person who lodged a submission, or who supported or opposed a submission, who is not satisfied with the Council's decisions on the proposal may appeal matters to the Environment Court if:
in relation to a provision or matter that is subject of the appeal, the person referred to the provision or matter in the person's submission on the proposal and
the appeal does not seek the withdrawal of the proposal as a whole.
